1. About OpenSpeak

OpenSpeak AAC is a free, open-source communication application developed by the OpenSpeak AAC Foundation, a 501(c)(3) nonprofit organization registered in Wyoming. The app helps non-verbal children and individuals with speech delays communicate using symbols, sentence building, and text-to-speech.

2. Acceptance of Terms

By downloading, installing, or using the OpenSpeak app or visiting our website at www.openspeakaac.org, you agree to be bound by these Terms of Use. If you are a parent or guardian using OpenSpeak on behalf of a child, you accept these terms on their behalf.

3. Who Can Use OpenSpeak

• OpenSpeak is intended for use by parents, caregivers, educators, and speech-language pathologists on behalf of children and individuals with communication needs.
• Children under 13 should use the app under the supervision of a parent or authorized caregiver.
• You must provide accurate information when creating an account or signing up for the beta.

4. The Service

OpenSpeak provides:

• Symbol-based communication with text-to-speech output.
• Multiple user profiles with customizable settings.
• Offline functionality for all core features.
• Optional cloud backup when you sign in with Google.
• Progress tracking and communication analytics.
• Support for 8 languages.

5. User Accounts

• Creating an account is optional. OpenSpeak works fully offline without an account.
• If you sign in with Google, your account is managed through Google and Supabase authentication.
• You are responsible for maintaining the security of your account and parent PIN.
• You may delete your account at any time by contacting us at hello@openspeakaac.org.

6. Acceptable Use

You agree not to:

• Use OpenSpeak for any unlawful purpose.
• Attempt to access other users' data or accounts.
• Reverse engineer, modify, or redistribute the app in a way that violates our open-source license.
• Upload harmful, offensive, or inappropriate content as custom symbols.
• Use the app in a way that could harm or distress a child.

7. Intellectual Property

a. OpenSpeak

OpenSpeak is open-source software. The source code is available under the terms specified in our repository. The OpenSpeak name, logo, and branding are trademarks of the OpenSpeak AAC Foundation.

b. ARASAAC Symbols

OpenSpeak uses pictographic symbols from ARASAAC (Aragonese Centre for Augmentative and Alternative Communication), created by the Government of Aragon. These symbols are licensed under Creative Commons BY-NC-SA 4.0. You may not use these symbols for commercial purposes outside of OpenSpeak.

c. Your Content

Any custom symbols, profiles, or data you create within OpenSpeak belong to you. We do not claim ownership of your content.

8. Medical Disclaimer

We do not make any claims about therapeutic outcomes. Every child is different, and results will vary. Always consult a licensed professional for diagnosis and treatment of speech or communication disorders.

9. Availability and Changes

• We strive to keep OpenSpeak available at all times, but we do not guarantee uninterrupted access.
• We may update, modify, or discontinue features at any time.
• We will notify users of significant changes through the app or by email.

10. Limitation of Liability

OpenSpeak is provided "as is" without warranties of any kind, whether express or implied. To the fullest extent permitted by law:

• The OpenSpeak AAC Foundation is not liable for any indirect, incidental, or consequential damages arising from your use of the app.
• We are not responsible for data loss due to device failure, uninstallation, or circumstances beyond our control.
• Our total liability shall not exceed the amount you paid for the service (which is $0 for the free version).

11. Termination

You may stop using OpenSpeak at any time by uninstalling the app. We may suspend or terminate access to accounts that violate these terms. Upon termination, your local data remains on your device. Cloud data will be deleted within 30 days of account deletion.

12. Changes to These Terms

We may update these Terms of Use from time to time. When we do, we will update the "Effective Date" at the top of this page. Continued use of OpenSpeak after changes are posted constitutes acceptance of the updated terms.

13. Governing Law

These terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of Wyoming.
